Terms of Service

1. Acceptance of terms

By using the Site, you represent that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms. If you do not agree, you must not use the Site.

2. Products and pre-orders

Fort sells consumer hardware products, currently available for pre-order. Pre-orders are subject to our Preorder Terms and Refund & Cancellation Policy. Product descriptions, pricing, and availability are subject to change at any time without notice.

We reserve the right to limit quantities, refuse orders, and cancel orders at our discretion. If we cancel your order, you will receive a full refund.

3. Pricing and payment

All prices are listed in US dollars. We reserve the right to correct pricing errors at any time. Payment is processed securely through Shopify at the time of order placement.

4. Order confirmation

Placing an order constitutes an offer to purchase. Your order is not confirmed until you receive an order confirmation email from us. Contact us at miranda@fort.cx if you believe there was an error.

5. Intellectual property

All content on the Site — including text, graphics, logos, images, and software — is the property of Fort Care Co or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.

6. User conduct

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.
• Transmit any harmful, offensive, or disruptive content.
• Scrape, crawl, or otherwise harvest data from the Site without our written consent.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

7. Referral and rewards programs

Participation in any Fort referral or rewards program is subject to the applicable Referral Reward Terms. Fort reserves the right to modify, suspend, or terminate any such program at any time.

8. Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

Our products are covered by a separate Limited Warranty to the extent stated therein.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FORT IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fort Care Co and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or related to your violation of these Terms or your use of the Site.

11. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

12. Changes to terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised “Last updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

13. Governing law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
